REPAIR BY INDIVIDUAL AND/OR LEGAL PERSON IN ENVIRONMENTAL DEGRADATION

Abstract

This article is intended to seek clarification under environmental law, about the degradation and the obligation of civil repair. Initially were addressed by individual repair in environmental degradation, repair by legal person in environmental degradation, addressing specific aspects of the relationship of liability with the damage to the environment, such as the question of moral and environmental damage reparability, especially regarding the collective moral damage and its repair in the environmental area. The bibliographic search methodology has, in the demotic Assembly ideas of renowned authors, Jair Leonardo Lopes as well, Paulo Affonso Leme Machado, and others. Between the final considerations can highlight the fact that the environmental law has received greater attention in recent years, with haven't approaches the importance normally attributed to other branches of law; and verification that the doctrine itself are alternative relevant to the issues of preservation and environmental remediation.
